Terms of Service

1. Acceptance of Terms

By creating an account or using Cropple.AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

2. Account Registration

To use Cropple.AI, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 16 years old to create an account.

You agree to provide accurate and complete information during registration and to keep your account information up to date. We reserve the right to suspend or terminate accounts that contain false or misleading information.

3. Subscription Plans and Billing

Cropple.AI offers Basic and Pro subscription plans, each providing different levels of access to features as described on our pricing page. Prices vary by region and are displayed in your local currency at checkout.

• 7-Day Free Trial: New accounts receive a 7-day trial with full Basic plan access. No payment information required to start.
• Paid Plans: Billed monthly or annually through Stripe. Your subscription renews automatically unless canceled before the next billing cycle.
• Upgrades: Take effect immediately. You will be charged the prorated amount for the remainder of your current billing cycle.
• Downgrades: Take effect at the end of your current billing cycle. You retain access to your current plan features until then.
• Cancellation: You may cancel your subscription at any time from your account settings. Access continues until the end of the current billing period.
• Refunds: We offer a full refund within the first 30 days of your initial paid subscription. After 30 days, no refunds are provided for partial months.

4. AI-Generated Advice Disclaimer

The recommendations, alerts, and insights generated by Cropple.AI are produced by artificial intelligence models and are intended to assist with farm management decisions. They are not a substitute for professional agronomic, veterinary, or financial advice.

AI-generated content may contain errors or inaccuracies. Cropple.AI does not guarantee the accuracy, completeness, or reliability of any AI-generated recommendations. You are solely responsible for any actions taken based on information provided by the Service.

5. Photo Uploads

When you upload photos for AI analysis, you grant Cropple.AI a limited, non-exclusive license to process those images solely for the purpose of providing you with analysis results. Photos are stored securely and are only accessible by you and the AI processing service.

You represent that you own or have the right to upload any photos submitted to the Service. You may delete your uploaded photos at any time through your account settings.

6. Data Ownership

You own your data. All farm data, field boundaries, crop records, livestock records, financial transactions, photos, and other content you submit to Cropple.AI remain your property. We do not claim ownership over any user-submitted data.

You grant Cropple.AI a limited license to use your data solely for the purpose of providing and improving the Service. We will never sell your data to third parties or use it for purposes unrelated to the Service without your explicit consent.

Upon account deletion, all your data will be permanently removed from our systems within 30 days, except where retention is required by law.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to other users' accounts or data
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools (bots, scrapers) to access the Service without permission
• Upload malicious content, viruses, or harmful code
• Resell or redistribute the Service without authorization
• Circumvent usage limits imposed by your subscription plan

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control.

Satellite imagery availability depends on weather conditions (cloud cover) and the Sentinel Hub service. Weather data depends on the OpenWeatherMap API. AI responses depend on Google Gemini availability. We are not responsible for interruptions caused by third-party service outages.

9. Limitation of Liability

To the maximum extent permitted by law, Cropple.AI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, crops, livestock, data, or goodwill, arising from:

• Your use of or inability to use the Service
• Any AI-generated recommendations or advice
• Inaccurate satellite imagery or weather data
• Unauthorized access to your account
• Service interruptions or data loss

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to Cropple.AI in the twelve (12) months preceding the claim.

10. Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to other users or the Service.

Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after account deletion to allow for recovery, after which all data will be permanently deleted.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Cookies

15. Data Portability

You may export all your data at any time from Settings > Privacy & Data. We provide your data in machine-readable JSON format per GDPR Article 20.

16. Right to Erasure

You may delete your account and all associated data at any time from Settings. Upon deletion, all data is permanently removed within 30 days per GDPR Article 17.
